Decision on sexual intercourse in Ramadan.. When is redemption necessary?
Intercourse between spouses in Ramadan is one of the things that cause many doubts, so what is the fact that it is forbidden in the holy month, and what is the regulation about intercourse with a woman during the day in Ramadan?
Ramadan is the month of fasting, prayer and study of the Qur’an, the month of liberation, mercy and forgiveness, the month of charity and charity, the month in which the gates of Paradise are opened and good deeds are multiplied in it, the month in which prayers are answered, ranks are raised, sins are forgiven, and God is merciful to his servants with all kinds of miracles.
Ramadan fasting is one of the five pillars of Islam that God imposed on all Muslims, so whoever completes the month and is healthy and not sick, or a resident who is not on a journey, fasting becomes a legal duty for him, whether he performs it or wears make-up.
Exceptions are the elderly, the elderly and those who have a chronic and serious illness that cannot be cured, because these two cannot fast Ramadan, nor make up for it or perform it.
Fasting is legally “restraint and abstinence with the intention of nullifying the fast and all that spoils the fast from the breaking of the second dawn until the setting of the sun.” That is, fasting is refraining from eating something tangible that enters a person’s stomach at a certain moment. period, which is from sunrise to sunset.
Intention is one of the conditions for eliciting the heart and determination to lean towards a person with the intention of reward and reward. That the servant distinguishes between habit and worship by his actions, so fasting is considered submission and closeness to God the Most High.
Ruling on intercourse during the day in Ramadan
Intercourse during the day in Ramadan is among the things that break the fast, and these are the things that break the fast, either by the absence of one of its conditions, or by disrupting one of its pillars.
The origin of these breakfasts is threefold and is mentioned in the Book of God in Surah Al-Baqara, where the Most High said: (Now divide it and seek what Allah has written for you and eat and drink until He shows you from one) which is the one that is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one who is the one.
Scholars of the people unanimously agreed that it is necessary to abstain from eating, drinking and sexual relations during fasting.
The second part is “that which breaks the fast and requires compensation and expiation.” It includes only sexual intercourse because it is the only act that breaks the fast and requires compensation and atonement.
Atonement is to free the slave, and if he cannot do that, let him fast for two consecutive months, and if he cannot, then feed sixty poor people.
Al-Azhar International Center for Fatwas stated in its fatwa entitled “44 questions about things that break the fast” that intercourse during the day in Ramadan, even without ejaculation, belongs to the list of things that break the fast.
And the Grand Mufti of Egypt, Dr. Shawqi Allam, stated that the relationship between a man and his wife during the days of Ramadan is invalid, impermissible and prohibited by law, and a person who commits such a sin must repent to his Lord, Glory be to Him, and must comply of what Prophet Muhammad obliged him to do.
The Mufti stressed the need for “a man and a woman to repent to God for the sin of sexual intercourse committed during the day in Ramadan by regretting what has passed and deciding that this act will not happen to them again in the future, and adhering to what came from the Prophet Muhammad, as, in that regard.”
The decision to break the fast in Ramadan with intentional sexual intercourse
The Ramadan fast is obligatory for every obligatory, healthy, permanently resident Muslim, and in case of breaking the fast during the days of the holy month for any reason, it is necessary to make up for it or pay a ransom.
The provision for the one who breaks the fast during Ramadan by intercourse is different from any other case of breaking the fast, he does not have to make up for it or pay a ransom, but fasting and redemption together.
Atonement is the punishment intended for any unauthorized or illegal violation of missing a day of fasting in Ramadan or committing one of the prohibitions of fasting.
As for the provision on breaking the fast for a person who intentionally had sexual intercourse with his wife on a Ramadan day, it is the obligation of the spouses to make up one day from the day on which the sexual intercourse took place, and the husband has to pay atonement, which is fasting for two consecutive months, and if he is not able, then feed sixty poor people.
According to a hadith from Abu Huraira, may God bless him and grant him peace, he said: While we were sitting with the Prophet, peace be upon him, when a man came to him and said: God! He said, “What’s yours?” He said: I had intercourse with my wife while I was fasting, so the Messenger of God, may the prayers and peace of God be upon him, said: “Can you find a slave to free him?” Ahl al-Bayt The Prophet, may God’s prayers and peace be upon him, laughed until his fangs were visible, then said: “Feed him to your family.” Deal.
And the Grand Mufti of Egypt, Dr. Shawky Allam, stated that “expiation is obligatory, along with the elimination of the one who committed a sin to atone for it, such as intentionally having intercourse with one’s wife during the day in Ramadan.”
Said Allam: “The missed fast is the fast of those days that the obligated person, male or female, broke the fast after the end of Ramadan, and it is obligatory on all those who broke the fast of Ramadan with or without excuse.”
And he added: “He spends the days according to the number of days he did not fast, and it is permissible to replace a winter day with a summer day, and it is also permissible to reverse it, compensating a summer day for a winter day, and the taxpayer must hurry to make up for the missed days of Ramadan before the second Ramadan begins.”
Regarding the legal provision on intercourse in Ramadan before dawn, Shaykh Ibn Baz, may God have mercy on him, said: “A man has intercourse with his wife at night and there is no harm in the whole of Ramadan, not even in the last one. ten days. There’s nothing wrong with her.”
